(3)    Legalisation/attestation of documents/ Powers of Attorney/Will etc.

The general principle is that any document signed/issued by a person abroad which has to be used/produced before the authorities in India has to be attested/legalised before the Indian Mission/Post concerned.

The requirements are:

Note 1: The document(s) must be signed in the presence of the Consulate officials
Note 2 : In case of Power of Attorney/Will, two photographs of the executant(s) are also required
Note 3: Affidavits/declarations can also be sworn/made before a Consular Officer on payment of the required fees.
Note 4: In case the signatory is not able to appear personally before a Consular Officer for compelling reasons, the following procedure may be followed:

If you are a British national/foreigner of Indian origin holding valid British passport/valid foreign passport, the requirements are:

The signatory is required to get their documents (and photograph(s) in cases of Power of Attorney) attested by a British Notary Public and then by the Legalisation Section of the Foreign and Commonwealth Office (FCO) (telephone number 020 7008 1111).  These can then be mailed to the Consulate along with the fee and a stamped self-addressed special delivery envelope or can be submitted at the Counter of the Consulate for attestation.  Any document signed in the presence of a Notary Public by a person who is not able to appear personally at the Consulate must be attested by the Legalisation Section of the FCO.

b)    India is one of the signatories to The Hague Apostille Convention and the new scheme was implemented in India on 29.8.2007.  The purpose of the Convention was to reduce the two stage authentication of public documents to one single stage.  If a public document is apostilled by the country of origin, it does not require re-authentication by authorities of the country in whose territory it has to be produced.
